The Communist Party of the Philippines denounces the Duterte regime’s foulest move in sowing false information surrounding the murder of Ka Randy Malayao. This aims to coverup the responsibility of state agents, specifically Rodrigo Duterte’s death squads, which he himself ordered to carry out the killing.

The Philippine National Police Regional Office 2 is not conducting any investigation on the brutal murder of Malayao on January 30, but is engaged in cover up by spreading intrigue and slandering Ka Randy, who has served the people throughout his life. The PNP is laying the stage for further extrajudicial killings of peace advocates, human rights advocates and other activists.

The revolutionary forces vow to attain justice for Ka Randy and punish the perpetrators of this fascist crime.

We cannot expect the traitor Duterte to heed the call of Justice Carpio to stand up for the territorial integrity and sovereign rights of the Philipines and the Filipino people in connection with the Chinese occupation and construction on the Kagitingan Reef (Fiery Cross).

In his electoral campaign for the presidency in 2016, he was financed by the China lobby and the plunderers like the Marcoses, Arroyos, Estradas, Remullas and Enriles. The armed minions of Duterte are complicit with him in treason.

Aside from being a traitor, he is bound to bigger plunder in connection with Chinese loans and infrastructure projects and to use state terrorism to assure him of absolute power and limitless accumulation of ill-gotten wealth.

Everyday that Duterte is in power, he victimizes the people with his treason, plunder and the most violent human rights violations. At the rate he is making the people suffer his tyranny and the worsening socio-economic crisis, he should not be allowed to stay long in power. ###

The false claim of Chief Superintendent Mario Espino, the regional director of the Philippine National Police in Cagayan Valley, that the murder of Randy Malayao was done by the NPA is a brazen intrigue of the vilest kind.

It has two malicious and evil purposes: 1. to cover up the criminal responsibility of the murdering agents of the Duterte regime and 2. to set the stage for further murders of suspected revolutionaries, peace and human rights advocates and critics by the death squads of the Duterte regime in the PNP and AFP.

Espino is playing the role of intriguer for the benefit of Duterte and his death squads. Duterte and all his armed minions are digging their own graves because they are goading the NPA to launch more tactical offensives by way of demonstrating that they are targeting those responsible for the rising and expanding crimes of state terrorism.

In the face of the propaganda of the Duterte regime to cover up the murder of Randy Malaya and further crimes of state terrorism, there is no other effective way for the NPA to prove the falsity of intrigues and attain a measure of justice for the victims but to deliver more lethal blows on those perpetrating the crimes of state terrorism.###

We, the National Democratic Front of the Philippines (NDFP) Negotiating Panel express our outrage and strongest condemnation on the brutal murder of Felix Randy Malayao, a publicly known consultant of the NDFP on political and constitutional reforms.

We condole with Ka Randy’s family, friends, comrades and colleagues as we give him our highest honor for his invaluable contributions to the revolutionary movement and the NDFP’s peace efforts.

He participated in the peace talks two years ago and was one of its spokespersons during the formal negotiations. He was an indefatigable worker in the service of the people and was ever ready to present the side of the NDFP in fora, seminars and consultations on the peace talks in the Philippines and overseas.

Ka Randy was a torture victim and a political prisoner for years under the Macapagal-Arroyo regime. He had been acquitted of all charges and was protected by the Joint Agreement on Safety and Immunity Guarantee (JASIG) as an NDFP peace consultant.

His killing may very well be a portent of worse moves against NDFP consultants for the peace talks many of whom, such as Vic Ladlad, Adel Silva and Rey Casambre, among others have already been arbitrarily arrested and slapped with trumped up charges.

From unilateral cancellation by the GRP to the flip-flopping statements of Duterte on the negotiations, the peace talks have been stalled as the Duterte government treads the path of all-out war and persistent attacks against the NDFP and its personnel for the peace negotiations.

Ka Randy’s brazen murder indicates an escalation of attacks against peace consultants and serves as a further serious obstacle to the resumption of the peace negotiations with the Duterte government.

The NDFP Negotiating Panel remains committed to the attainment of a just and last peace in the Philippines through peace negotiations. The militarist and terrorist government of Duterte, however, is hell-bent in sabotaging the pursuit for just peace as it intensifies attacks against the NDFP and enables brazen acts such as the murder of Ka Randy.

The heroes hall of the Philippine revolution welcomes Ka Randy. His martyrdom and his untiring work will always be remembered and inspire the struggle against tyranny and for a just peace.###

NDFP consultant Randy Malayao was not yet murdered by the armed minions of the Duterte regime when I reiterated yesterday the policy of the NDFP of being open to peace negotiations even with the regime. The heinous murder manifests the scheme of the Duterte regime to shun peace negotiations in the first place, escalate its attacks on the people and their leaders and use its all-out war on the revolutionary forces and people as the very excuse for imposing a fascist dictatorship on the people.

In view of the murder of NDFP consultant Randy Malayao, the NDFP and all revolutionary forces within its fold are now in the process of reconsidering its policy of being open to peace negotiations with the GRP under the Duterte regime and are more than ever determined to carry out the overthrow of the the treasonous, tyrannical, murderous and corrupt Duterte regime.

It can be expected therefore that the murder of Randy Malayao and other criminal offenses of the Duterte regime will result in the intensification of revolutionary armed struggle nationwide against a regime hell-bent on going down in history as a butchering monster and enemy of the cause of just peace. The blood of martyrs is never shed in vain. It inspires the greater resistance of the people to tyranny.

The NDF in Cagayan Valley region, with all its allied organizations and member individuals, condemns the murder of NDF Consultant Felix Randy Malayao by death squad elements of the 5th ID at 2.30 am today inside a bus while on a stop at Darapidap, Aritao, Nueva Vizcaya.

His death is the latest among the fascist US-Duterte regime’s attacks against the people, in a desperate and bloody attempt to fulfill his forecast that the revolutionary movement can be crushed by the middle of the year. At the time of his death, Comrade Felix was covered by the Joint Agreement on Safety and Immunity Guarantees that stipulates, among others, that consultants like him should not be harmed nor arrested.  

Comrade Felix was a humble servant of the masses, who spent 33 years of his life arousing, organizing and mobilizing the people against an unjust ruling system. He was an exemplary revolutionary, whose favorite motto was “Others First.” He lived among the peasants and workers of Cagayan Valley, later serving as the region’s representative to the NDF-GRP Peace Talks, all the while performing other revolutionary duties. 

He was abducted and tortured in 2008 before being imprisoned for four years, but steadily returned to the people’s movement after being released. It is a proof of his unwavering commitment to the people that the US-Duterte regime’s men had to kill him while sleeping, in the dead of the night, because they could not stop him otherwise. 

We call on all justice-loving citizens of the region to join various actions to protest Comrade Felix’s murder and to seek justice for his death and countless other more victims of Duterte and the 5th ID’s bloody war.  

It is foolish of the ruling class to expect that it can crush a powerful revolutionary movement by cowardly killing its leaders and members. The longer the US-Duterte regime struggles to retain in power by employing brutality, the stronger and more tenacious the people will become. Deaths like Comrade Felix’s give them enduring inspiration.###

Condemn US imperialism, firmly support President Nicolas Maduro and the Bolivarian Republic of Venezuela

The revolutionary Filipino people vigorously condemn US President Donald Trump for trampling on the national sovereignty of the Bolivarian Republic of Venezuela. His latest vile action against the heroic Venezuelan people is to disregard the democratic election of President Nicolas Maduro and give an invalid stamp of so-called recognition to the self-proclaimed usurper, Juan Guaido of the rightwing opposition in Venezuela.

President Trump had earlier undermined the Bolivarian Republic by instituting wide ranging economic sanctions that have caused serious damage to Venezuela’s economy and grave suffering on the Venezuelan masses.

President Trump has gotten his rightwing cohorts among the Latin American governments, such as  Colombia and Brazil, to threaten a military coup against President Maduro.

The revolutionary Filipino people stand in firm solidarity with President Nicolas Maduro and the Bolivarian Republic of Venezuela. 

The continuing firm support of the Venezuelan people for President Maduro and his government is completely in accord with the effective legacy of Comandante Hugo Chavez Frias and the inspiration of the Great Liberator Simon Bolivar.

In our visits to Venezuela, especially the Communes of Nueva Tacagua and El Limon, we heard the inspiring cries of the Venezuelan people: “Chavez vive, la lucha sigue!” and “Chavez no murio, se multiplico!”

At this time of grave sabotage by US imperialism and its cohorts, the fighting spirit of the Great Comandante Hugo Chavez Frias and the inspiration of Simon Bolivar, are the deep source of strength of the Venezuelan people, President Nicolas Maduro and the Bolivdarian Republic.

The revolutionary Filipino people have been waging an ongoing struggle for fifty years, for freedom, independence and national sovereignty against US imperialism and its cohorts among the local reactionries. We once again convey our firm solidarity for President Nicolas Maduro, the Venezuelan people and the Bolivarian Republic of Venezuela.

Rehashed amended petition to proscribe CPP-NPA is a piece of legal fiction with dire consequences for the people

The amended petition submitted by the Department of Justice of the Government of the Republic of the Philippines (GRP) seeking to proscribe the Communist Party of the Philippines (CPP) and the New People’s Army (NPA) is a piece of legal fiction with dire consequences for the people.

The Negotiating Panel of the National Democratic Front of the Philippines (NDFP) which represents these allied organizations in peace negotiations views the amended petition as part of the GRP’s desperate moves to impose a full-blown fascist dictatorship, scrap the May 2019 elections, and establish a fake federal state with local dynasties beholden to the dictator in control of the so-called regional states.

The amended petition is groundless and merely a rehash of previously disproven charges in old cases, both in the Philippines and abroad, that have either been definitively resolved, dismissed with finality, and obviously prescribed or are already being contested in proceedings before GRP courts – against trumped up charges with the use of moving skeletons and manufactured witnesses as evidence.

Moreover, the link between the eight remaining individuals alleged to be officers of the CPP and NPA and the purported terrorist acts does not exist. Such legal hocus-focus completely disregards accepted international principles and practices on due process, double jeopardy, bill of attainder, freedom of thought, and the like.

Up to now there is still no acceptable definition of terrorism in the world. The United Nations (UN) has none. Even the GRP’s own Human Security Act tacks its meaning on a broad compilation of acts already deemed as offenses in its penal laws. The Act only serves to set aside and in effect nullify without any just basis the GRP’s long established jurisprudence on the Hernandez political offense doctrine.

The amended petition caps the all-out “legal offensive” by the GRP against the revolutionary forces, starting with Proclamations 360 (terminating peace negotiations) and 374 (declaring CPP and NPA as “terrorist organizations”), as well as Memorandum Order No. 32 (deployment of more security forces in selected areas to suppress “lawless violence and acts of terror”) and Executive Order 70 (creating national task force to end “local communist armed conflict”), coupled with an insidious arsenal of tools that have resulted in the illegal arrests of NDFP consultants that undermine the GRP-NDFP Joint Agreement on Safety and Immunity Guarantees (JASIG), the Comprehensive Agreement on Respect for Human Rights and International Humanitarian Law (CARHRIHL) and other binding bilateral agreements.

The petition is definitely against the interest of the Filipino people who desire a just and lasting peace through negotiations and agreements on social, economic and political reforms. For the GRP to attempt to proscribe the CPP and NPA makes returning to the negotiating table to address the roots of the armed conflict even more complicated if not altogether impossible.

On the principled basis that the CPP and NPA adhere to the people’s democratic government, which has its own judicial system, the CPP and NPA cannot and will not enter the GRP court to participate in the proceedings.

The NDFP, however, is gravely concerned of the dire and adverse impact and consequence of the amended petition to legal democratic organizations and activists due to the GRP’s policy of linking activists and government critics to the CPP and NPA and tagging them as “terrorists” or involved with “terrorist organizations and acts.” There is imminent danger that they will be subjected to the arbitrary measures allowed under the Human Security Act.

The CPP and NPA will continue to defend the national and democratic aspirations of the Filipino people to achieve thoroughgoing land reform, national industrialization, environmental protection, and genuine national sovereignty. Hence, any attempt of the GRP to proscribe and brand the CPP and NPA as terrorist organizations will be futile.###

Duterte regime is engaged in anticommunist witch-hunt against teachers, lawyers. Journalist and others

The Duterte regime and its military and police minions have utterly failed to destroy the New People’s Army before the end of 2018 as they boastfully threatened in October 2017. They have not destroyed a single NPA guerrilla front. And they know that they cannot destroy the NPA before Duterte himself is out of power.

But Duterte and his armed minions have the antidemocratic and evil notion that they can complement their all-out war or make up for their failure to destroy the NPA by unleashing an anticommunist witch-hunt against teachers, lawyers, journalists, youth, women, social activists, human rights advocates, religious and other people whom they consider as open prey for state terrorism. They will find it more messy and scandalous to blacklist and murder members of the intelligentsia than the poor slum dwellers, peasants and indigenous people.

They are unleashing the anticommunist witch-hunt in connection with their threat to carry out the “Indonesian solution” by massacring communist suspects. They calculate maliciously that they can actually murder a number of urban-based critics and opponents of the Duterte regime in order to frighten the entire lot of the intelligentsia and other people in the cities to stop them from exposing and opposing the crimes of the regime and ills of the ruling system.

It is in the context of the anticommunist witch-hunt that PNP’s Albayalde tries to use my name for his vile purposes. I say categorically that Albayalde is a big liar. He is capitalizing on a distorted spy report on a 30-year old video of a speech of mine in Brussels in which I actually differentiated the legal democratic forces and the forces of the armed revolution.

I have never identified or enumerated any legal organization as a “front” or facade of the CPP. The language is entirely that of the un-intelligent or stupid witch-hunting police dog Albayalde. I have always referred with respect and accuracy to legal organizations adhering to the line of national independence and democracy as legal democratic formations independent of the CPP. 

I never castigate a mere running dog alone. I hold his master Duterte most responsible for the current anti-communist witch hunt against teachers, lawyers, journalists, social activists, human rights advocates, religious and other people. He is a malicious rascal who has nothing to offer to the people but mass murder and mass intimidation in addition to his brazen acts of puppetry and treason, corruption and plunder, machismo and misogyny, foul language and mendacity.###

On Duterte’s statement of being open to peace negotiations

Enemies need peace negotiations before they can become friends or partners for the sake of the Filipino people who desire social, economic and political reforms as basis for a just and lasting peace.

Thus, I welcome the statement of Duterte that he is still open to peace negotiations even as there is still an exchange of hostile words in the mass media and exchange of bullets in the battlefield.

It is the consistent policy of the NDFP to be open to peace negotiations with the Duterte regime despite the determination of the NDFP to seek the ouster of this regime.

It is for the benefit of the people that the peace negotiations resume and stop the Duterte regime from proclaiming martial law nationwide, from calling off or rigging the May 2019 elections and from pursuing the scheme to impose a fascist dictatorship on the Filipino people via charter change for a bogus kind of federalism.

The NDFP presumes that, when peace negotiations resume, the way is open to the forging of agreements on social, economic and political reforms that are desired and needed by the people.###
