Duterte is a bloodthirsty tyrant with a malicious criminal mind

Since he became president in 2016, Duterte has unleashed his all-out war against the revolutionary movement. There has been no letup in violent attacks and human rights violations by his armed minions even during periods of ceasefire in the course of the GRP-NDFP peace negotiations.

Every time there is an incident which he wishes to blame on the NPA, he goes ranting to the press instead of letting his negotiating panel submit the complaint to the Joint Monitoring Committee of the GRP and NDFP. But worst of all, he calls on his armed minions to go further on killing rampages.

Duterte is a bloodthirsty tyrant, whose favorite mantra is kill, kill, kill! And he has a malicious criminal mind, using any kind of resistance to his all-out war as a further cause for mass murders. He has terminated the GRP-NDFP peace negotiations in line with his tyrannical character and mad drive for fascist dictatorship.

He has disdain for the ceasefire announced by the CPP Central Committee in solidarity with the Filipino people in the Yuletide season. But he demands that the NPA ceases fire on days outside of the time frame of the 5-day ceasefire announced by the CPP Central Committee: 12:01 a.m. of December 24, 2018 to 11:59 p.m. of December 26, 2018, and 12:01 a.m. of December 31 to 11:59 p.m. of January 1, 2019.

Duterte has shown no mercy to the Filipino people, especially the workers, peasants and other people. He has imposed on them a heavy tax burden and soaring prices of basic commodities. Worst of all, he has given his armed minions license to kill them with impunity on mere suspicion.

He has also shown no mercy to his ordinary troops whose families remain poor despite their doubled salaries and license to kill. Even in the Yuletide season, he deprives them of rest and relaxation with their families and wears them out with military operations that fail against the NPA and that succeed only in harming the people and damaging their livelihood and the civility of their lives. ###.

Comment on EO 70

EO 70 does not make the armed counterrevolution civillian-centric. But it seeks to weaponize the civil bureaucracy for the armed counterrevolution or military suppression of the revolutionary government and movement of the people.

It limits the GRP to the framework of military suppression and psywar use of fake surrenders and fake encounters, misrepresented as “localized peace talks”. The OPAPP is now emphatically militarized with the appointment of a rabid anti-communist general as secretary.

EO 70 is one more presidential issuance to terminate and prevent the resumption of peace talks at the appropriate national level between authorized representatives of the GRP and NDFP. It is furtherance of the de fact martial rule and the scheme of imposition a full-blown fascist dictatorship on the people.

It is in line with the anti-peace Proclamations 360 and 374, Memorandum Order 32, the arrest of NDFP peace consultants and the deployment of Duterte death squads in both urban and rural areas against suspected revolutionaries and critics of and opposition to the tyrannical and corrupt Duterte regime.

On this International Human Rights Day, it is fitting and proper to reflect on the Duterte regime’s vicious human rights violations in its drive to impose a fascist dictatorship on the Filipino people. Thus, the appropriate and effective courses of action can be defined for upholding, defending and promoting human rights.

The tyrant Duterte, his ruling clique and their armed minions in the AFP and PNP have been carrying out a creeping coup against the 1987 Constitution of the reactionary government since he assumed office in 2016. He has steered the coup through a number of phases. These are calculated to speed up and reach climax in 2019.

1) Duterte surreptitiously began his all-out war against the revolutionary movement by extending Oplan Bayanihan until the end of 2016 and then declared his own Oplan Kapayapaan in January 2017 while he used as decoy his short-lived pretense of peace negotiations with the NDFP.

2) He implemented his scheme to turn the military and police into his private armies by promoting his favorite officers in the AFP and PNP and corrupting more officers with incentives in cash and promotions for listing and killing suspects with impunity.

3) He projected the image of a strong man with iron fist and drummed up his ability to kill people by unleashing Oplan Tokhang to kill thousands of drug suspects, declaring martial law in Mindanao and destroying Marawi City for the purpose of mass intimidation.

4) He used turncoatism and the pork barrel to take control of Congress and also used Arroyo’s and his appointees in the Supreme Court to effect the release of the biggest plunderers, thereby paying his political debts to them and keeping them as mates in a cabal of corruption.

5) He deliberately terminated the peace negotiations with the NDFP in order to scapegoat the CPP and NPA as the pretext for de facto martial law nationwide and terrorist acts of suppression and making threats of formally proclaiming martial law nationwide or a “revolutionary government”.

6) He has steadily pushed the preparations for charter change to a bogus kind of federalism by which he can concentrate powers in his hands and handpick his regional and provincial agents from among the dynasties nd warlords.

7) He has attacked the Catholic Church from time to time in order to test how far people can react to him, cursing the God and religious beliefs of the Catholic masses, causing the murder of a number of priests and threatening to kill all bishops for being critical of him and being supposedly useless.

8) He has escalated his all-out war against the revolutionary movement in Mindanao and nationwide and has in fact imposed a de facto martial law on the entire nation in preparation for fixing the results of the 2019 elections.

9) He has engaged in plunder of public funds and taken over controlling shares in private contracts with the state and even in the illegal drug trade and casino gambling under the pretext of collecting money for the benefit of ordinary soldiers and for the forthcoming elections.

10) He has boasted of being able to maintain US support and at the same time of enjoying the support of China in terms of protection from any possible coup as well as in terms of securing loans and infrastructure projects in exchange for his treasonous sell-out of the sovereign rights of the Philippines in the West Philippine Sea.

The Duterte ruling clique keeps on harping on the threats of terrorism and destabilization plots in order to use these as cover and pretext for the coup that Duterte himself is masterminding against the 1987 Constitution and the Filipino people.

It is the duty of the entire Filipino people to stand up, fight and frustrate Duterte’s scheme to grab absolute power as a fascist dictator a la Marcos under the guise of establishing a federal system of government. He is already culpable for the many grave crimes that he, his ruling clique and their armed minions have committed.

It is necessary for all patriotic and democratic forces and the rest of the people to unite in a broad united front and mass movement to oust the Duterte regime as soon as possible. The change can be achieved under any of the effective processes of the 1987 Constitution. The most effective is for the millions of people to take to the streets and encourage the patriotic sections of the AFP and PNP to start the withdrawal of support from the brutal and corrupt tyrant. ###

On Duterte’s pseudo-independent foreign policy

Panelo should closely read my statements about the West Philippine Sea issue to appreciate that I use a wide range of Philippine and international sources as basis for my views. There is nothing wrong about any factual and reasonable estimate of the rent and damages that China should be paying for occupying the artificial islands and damaging the marine environment.

There is nothing wrong in using any source of information like Marx studying the theories and documents of capitalism in order to critique capitalism and project socialism. As a lawyer, Panelo should know that various types of witnesses can be availed of to establish facts and the truth.

At any rate, I advise Panelo to read my latest article, “Duterte has gone into a waiver of Philippine sovereign rights but China demands explicit surrender of these rights.” I am well-informed enough to know the differences between certain views of Justice Carpio and former Solicitor General Hilbay and the overt and covert traitorous actions of the Duterte regime with regard to the West Philippine Sea issue. Definitely, I follow Philippine events and trends so closely that I know who will benefit from contract shares, commissions and finders’ fees as a result of the sell-out of Philippine sovereign interests.

The Duterte regime is not pursuing an independent foreign policy, contrary to Panelo’s claim. It is pursuing a policy of subjecting the Philippines to the continuing over-all US dominance and to the incoming debt colonization of the Philippines by China and the surrender of the sovereign rights of the Filipino people in the West Philippine Sea. I do not have to go to the Philippines right away to be able to know Duterte’s foreign policy of subservience to several imperialist powers, especially the glaring obedience to China.

Panelo’s boss Duterte is so brave when he threatens and actually induces mass murders of poor people by his armed minions. But he is so cowardly and servile in dealing with China regarding the sovereign rights of the Philippines and the Filipino people. In contrast, Vietnam has demonstrated that it can file diplomatic protests against China on a bilateral and multilateral basis and still maintains diplomatic and trade relations with China. Obviously the Vietnamese authorities do not have shady deals with China and Chinese corporations like Arroyo and Duterte and their Chinese comprador partners have.

Without any danger of war with China, the Philippines can file diplomatic protests on a bilateral basis and in international forums, sue China in the US and other courts where Chinese assets exist in order to obtain rent and damage compensation and even demand Chinese departure from the artificial islands. The Philippines can also hire non-Chinese and more competent corporations in service contracts to help the Philippines and its Filipino experts to explore and develop Philippine oil and gas resources.

Panelo does not gain any additional point in argumentation over the issue by mocking at the comprehensive and long-term ideological position of the Communist Party of the Philippines. He exposes his ignorance about the immediate general line of the CPP in waging the new democratic revolution against the decrepit and bankrupt semicolonial and semifeudal ruling system. Also, only an idiot can presume that capitalism and imperialism are perpetual, especially at this time that the crisis of the world capitalist system is going into another major spasm.

Brutal and corrupt leaders of the Philippine semi-colonial and semifeudal ruling system of big compadors, landlords and bureaucrat capitalists like Marcos, Arroyo and Duterte and their subalterns like Panelo have no claim whatsoever to any moral or political superiority over the lowliest revolutionaries who are leading the workers, peasants and the rest of the people in their struggle for national and social liberation.

Panelo is in the Philippines but is ignorant of the fact that the CPP, the NPA, the NDFP and the mass organizations of workers, peasants, indigenous people, youth, women and other people have built the People’s Democratic Government through the local organs of political power. He is shooting his own foot by stupidly saying that these revolutionary forces and people have not built any political power in the past 50 years.

There are now two governments in the Philippines: the People’s Democratic Government in the countryside and the city-based reactionary government of the exploiting classes. He and Duterte will soon be out of power. They belong to a merely passing regime of short duration in a ruling system that will be overthrown eventually by the people’s democratic revolution.

It is Panelo who is grossly out of touch with reality in the Philippines and in his immediate vicinity. He is conspicuously suffering from senility or fragmentary thinking. He is the spokesman of Duterte and invites me to return to the Philippines. He has so easily forgotten the fact that Duterte only a few days ago said that I should not return to the Philippines and he threatened me with physical harm from himself no less should I return to the Philippines.###

Justice Carpio is overoptimistic and wrong that China will accept a mere service contract to give up China’s baseless claims over the West Philippine Sea and recognize the sovereign rights of the Philippines in accordance with the UNCLOS and the legal victory of the Philippines before the Permanent Court of Arbitration in July, 2016.

Former Solicitor General Hilbay is correct that the Duterte regime has already treasonously and stupidly made a waiver of Philippine sovereign rights by falling silent on these and putting these at par with the false claims of China in the MOU on the joint China-Philippine joint exploration and development of the oil and gas resources under the West Philippines Sea.

But China itself is not yet satisfied with the mere waiver by implication of the Duterte regime’s falling silent on the Philippines’ sovereign rights and putting these at par with the false claims of China. China wants an explicit and categorical surrender of Philippine sovereign rights to China.

Thus, China is using as leverage Duterte’s own inane obsession with getting high interest loans worth USD 9 to 24 billion for some 29 overpriced infrastructure projects. After more than two years since Duterte’s trip to China in October 2016, China has started no more than two infrastructure projects worth far less than USD 1 billion.

Even at this stage, Duterte cannot be sure that he can benefit from his false and stupid calculation that the burdensome and exploitative Chinese loans will buoy up his regime and the Philippine economy.

Even if the Chinese pledge of USD 9 to 24 billion loans were realized, these would further deteriorate the Philippine economy in conjunction with the accumulated loans from the traditional lenders whose interest rates are now rising rapidly in line with the US-initiated policy of quantitative tightening.

The Duterte regime is already moving into the second half of its 6-year term. These are lameduck years for Duterte amid the rising mass movement for his ouster, the bankruptcy of the reactionary government, stinking corruption of the bureaucracy and the military and a growing split between pro-US and pro-Duterte factions within the AFP and PNP.

The isolation and detestation of Duterte by the broad masses of the people are the result of the tyranny and brutality of the regime, rampant corruption, the rising unemployment and dwindling incomes, the mounting tax burden and soaring prices of basic goods and services, the treasonous sell-out to China and other major causes.

In view of certain recent acts of the tyrant Duterte, he is accelerating the realization of his scheme to declare martial law nationwide and impose a full-blown fascist dictatorship on the people.

Duterte is closing all doors to peace negotiations. He has caused OPAPP Secretary Dureza to resign in order to put OPAPP under total military control in line with Duterte’s policy of militarizing his cabinet. He is giving way to the demands of the military.

The military want to control OPAPP to prevent serious GRP peace negotiations with the NDFP by imposing the precondition of surrender on the NPA. .They also want to place the billlions of pesos of OPAPP and Pamana funds under the control of the military. The issue of corruption against Dureza’s undersecretaries is a mere pretext because the Office of the President itself is the stinking center of corruption.

The military officers and some mayors have become notorious for pocketing privately E-CLIP funds for fake surrenderers. Now, they want to take over the PAMANA under OPAPP. The racket in PAMANA is also in the invention of fake beneficiaries and in favoring political favorites among local officials.

In a flagrant expression of lawlessness and barbarism or even madness, Duterte has announced the formation of death squads with the license to kill just anyone who is suspected of being or still becoming NPA. He has specified as targets of the death squads any istambay (idler), any critic, any activist or just anyone whom the death squads suspect or think of becoming or being NPA.

He wants Oplan Kapayapaan to compete with Oplan Tokhang in murdering thousands of people. He is obviously becoming desperate because Oplan Kapayapaan has failed to defeat the NPA in the guerrilla fronts. Not a single guerrilla front has been destroyed even in Mindanao where he has concentrated 75 of his total of 98 maneuver battalions under conditions of martial law.

Now, the NPA is increasingly carrying out tactical counteroffensives in the countryside of Mindanao, Visayas and Luzon. But the NPA is not yet fielding commando teams to urban areas in consideration of the CPP policy that the character the urban mass struggle is legal and defensive.

It is only Duterte who has conjured the illusion that the urban areas are already swarming with “sparrow units” in urban areas in order to have the pretext for forming his death squads to threaten and use against his urban-based legal opponents.

Duterte has gone out of his mind. As Catholic Bishop David has observed, he is mentally sick. He needs psychiatric help and should be removed from his position.###

It is absolutely clear from the full text of the Memorandum of Understanding on Cooperation on Oil and Gas Development Between the Government of the Republic of the Philippines (GRP) and the People’s Republic of China (PRC) that the GRP keeps silent, ignores and sets aside the conclusive and final legal victory of the Philippines in its case against China before the Permanent Court of Arbitration in accordance with the UN Convention on the Law of the Sea.

In principle and in practical terms, the Memorandum at least puts China at par with the Philippines, despite the fact that the Philippines has indisputably, according to international law and final court judgment, the sovereign rights and sole ownership of and authority over the oil, gas and other resources in any possible “relevant area” or “working area” in the West Philippine Sea.

The signing and approval of the Memorandum under the direction of Duterte is a clear act of treason, a blatant betrayal of the sovereign rights and national patrimony of the Philippines and the Filipino people. While it is still arguable that the Memorandum is still merely an “agreement to agree”, the Philippines and the Filipino people must effectively reject the Memorandum.

Even then, a significant amount of damage has been done by the Duterte regime to the sovereign rights and national patrimony of the Filipino people. By citing the Memorandum, China can now insist ad nauseam and by force that the Philippine government has waste-basketed the final judgment that the mineral and marine resources under the West Philippine Sea belong to the Philippines.

To overcome the damage and counter the act of treason, the Philippines and the Filipino people must act immediately to nullify and waste basket the Memorandum. Otherwise the traitor Duterte and his subalterns will commit more crimes of treason under the rule of confidentiality agreed upon in the Memorandum. This is a confidentiality serving the traitors and thieves at the expense of the Filipino people who are kept in the dark and subjected to surprises by fait accompli.

The practical counteraction to the treason committed by Duterte and the threat of aggression by China is for the Philippines to promptly muster its own patriotic Filipino experts and to hire the needed foreign oil and gas development company, that accepts Philippine sovereign rights and ownership over the resources, is superior to China in undersea oil and gas exploration and development, carries the protection of its own country and the international community of nations and is independent of the US and China.

If the Memorandum is allowed to stay and elaborated further by the Duterte-lining crooks in collaboration with China and its Chinese corporations, it will become intertwined with legal and political provisions in contracts that require economic and trade and loan agreements to be governed by and construed in accordance with Chinese laws and any dispute with the Philippines on the terms of contracts to be settled through arbitration by the China International Economic and Trade Arbitration Commission. These provisions overrule any Philippine silence or equivocation about Philippine sovereign rights in the West Philippine Sea.

In a previous statement, I pointed out the following: By allowing China to be a partner and co-owner of joint undertakings to explore and exploit the energy resources in the West Philippine Sea, the Philippines is made to fall silent on and give up its sovereign rights and allow Chinese corporations to explore and exploit oil, gas and other resources, with Chinese corporations monopolizing the findings of explorations and the accounting of costs and outcomes in exploration and exploitation.

While the Duterte-lining crooks are selfishly interested in paltry contract shares and finders’ fees, China has foresight and depth in its scheme to turn the Philippines into a debt colony and to usurp not only the mineral and marine resources in the West Philippine Sea but also elsewhere in the Philippines. The unrepayable high interest loans and overpriced infrastructure projects will weigh heavily on the Filipino people and will allow China to control and take over the natural resources and economy and even the political life of the Philippines.###

What is Duterte in peace negotiations? A clown, a dolt or a dopehead?

Duterte is simply joking, stupid or crazy when he publicly proposes that the NDFP submit to him a draft peace agreement for him to approve, subject to the further approval of the AFP and PNP. He pretends not to know that there is a negotiating process or he is so drugged by fentanyl that he does not really know it.

Before he finally terminated the peace negotiations, both the NDFP and GRP negotiating panels had already made their respective drafts of the comprehensive agreements on social and economic reforms (CASER) and on political and constitutional reforms (CAPCR) and had made substantial progress in reconciling their drafts of CASER.

Duterte seems to imagine that the NDFP is like China which has enough money to bribe him to let it draft a major document for his consent and approval. But he exposes further his inane mind by admitting that he would still need the ultimate approval of the military and police.

He acknowledges that he stands in fear of coup d’etat by the military and police and he actuallly claims that his supposed authority as political leader and commander-in-chief of the GRP and its armed services is inferior to the authority of the military and police. What kind of president does the GRP have? A clown, a dolt or a dopehead?

Memorandum Order No. 32 is formally and actually a declaration of a state of national emergency. This is in furtherance of the ongoing tyranny and de facto martial law nationwide. It is preparatory to formal proclamation of martial law nationwide, the screwing up of the 2019 elections, chacha for bogus federalism and establishment of fascist dictatorship ala Marcos.

The lawless violence that now reigns in the Philippines is actually a monopoly of the AFP and PNP, especially with their perpetration of mass murders with impunity and with presidential protection and cash incentives from the intelligence and discretionary funds of the Office of the President.

In sharp contrast, the NPA follows strictly the laws of the people’s democratic government, the International Bill of Rights and International Humanitarian Law. Duterte has generated the lawless violence under Oplan Tokhang and Oplan Kapayapaan in order to lay the ground for further brutal military and police operations and for justifying martial law nationwide and establishing a fascist dictatorship.

Having authorized MO No. 32, Duterte is unwittingly admitting that the NPA is strong not only in Mindanao but also in other parts of the country contrary to the psywar claims of the AFP and PNP that the NPA is nearly finished. In fact, not a single guerrilla front in Mindanao has been finished, despite the deployment of 75 of the 98 maneuver battalions of the AFP.

The NPA is expected to wage more tactical offensives on a nationwide scale. Outside of Mindanao, the AFP and PNP have targeted so-called focus areas. But their offensives have been blunted and have uttterly failed in Luzon and the Visayas.

Duterte and his armed minions do not understand the guerrilla warfare being carried out by the NPA. They think that the NPA is already finished when it evades the enemy offensives with superior strength.

They forget that the NPA can launch tactical counteroffensives after evasive actions and it can avail of its nationwide strength to launch tactical counteroffensives elsewhere on a wide front in a war of fluid movement.

If only to stop Duterte’s scheme of fascist dictatorship, the NDFP maintains its standing policy of being open to peace negotiations with the GRP even under Duterte. Most importantly, it is putting forward its proposal for social, economic and political reforms to lay the basis for a just and lasting peace.

At the same time, the revolutionary forces represented by the NDFP have made absolutely clear that they will continue to carry out the people’s war for national and social liberation in response to Duterte’s termination of the GRP-NDFP peace negotiations, his persistent all-out war policy and his scheme of fascist dictatorship.

The NDFP is well aware of the instability and fragility of the Duterte regime. The tyrant Duterte has worn out and fatigued his limited military and police forces and cannot increase them because of the worsening economic crisis and financial bankruptcy of his regime, aggravated by debt enslavement to China which will start to weigh heavily on the Philippines next year.

Within the AFP and PNP, there is only a small criminal gang loyal to Duterte. This is directly opposed by pro-US and anti-China military officers. At the same time, there is a growing number of patriotic and democratic-minded AFP and PNP officers who aim to withdraw support from the Duterte regime in concert with the people’s uprising as in 1986 and 2001 against the Marcos fascist regime and the Estrada regime, respectively.

Duterte seems to be aware that he is sitting on a throne made of bayonets. Thus, now and then, he publicly expresses fear of a coup d’etat. Indeed, he is vulnerable to a coup d’etat by the group of pro-US and anti-China officers or to a combination of people’s uprising and military withdrawal of support as he takes further steps in making his own authoritarian coup against the GRP Constitution. ###
